PURPOSE OF THE POLICY:
- To protect the health, safety and quiet enjoyment of the members, occupants, visitors, and employees of the Co-op.
- In alignment with the Alberta Government and the Alberta Gaming and Liquor Commission the Co-op commits to keeping cannabis out of the hands of children and youth.
- The Co-op seeks to promote safety on Brittany Lane Property and all persons on the property including reducing fire hazards and property damage related to the spread of mold, spores, and fungus through ventilation systems.
DEFINITION OF TERMS
- “Smoking Cannabis” for the purposes of this policy means to inhale, exhale, burn, heat, or otherwise have control over any smoking implement designed to burn cannabis for the purpose of inhaling or tasting of its emissions.
- “Business invitee” for the purposes of this policy shall include but is not limited to any contractor, tradesperson, agent, household worker, or other person hired by the Co-op or member to provide a service or product;
- “Duty to accommodate” for the purposes of this policy means the legal duty of the Co-op to take reasonable steps, in policies, and living conditions to accommodate a member or occupant’s individual needs.
POLICY
- All forms of smoking cannabis are strictly prohibited on Co-op property inside or outside any building subject to the Alberta Human Rights Act, as per item #5.
- Growing cannabis inside units is strictly prohibited. (Note: In Provincial Law it is illegal to grow cannabis outside as this gives more access to underage persons)
- This policy applies to all persons including but not limited to members, occupants, invitees, business invitees, and visitors/guests.
- The Co-op has a duty to accommodate a member or occupant who has proven medical evidence that they have a disability requiring the smoking of cannabis.
- The member must present to the board a medical document, authorized by a medical specialist advising the cannabis must be consumed by means of smoking. The member must also present authorization to possess in accordance with provincial and federal laws.
- Whether the member or occupant has proven the disability will be determined in the sole and absolute discretion of the board acting reasonably.
- The Co-op may make a reasonable accommodation, if a member, or occupant proves that to prohibit smoking or growing cannabis would result in other discrimination prohibited by the Alberta Human Rights Act.
- The board, in its sole discretion, will determine if the resident has proven that the prohibition of smoking or growing cannabis would be discriminatory pursuant to the Alberta Human Rights Act.
- Types of discrimination prohibited under the Alberta Human Rights Act are race, religious beliefs, colour, gender, gender identity, gender expression, physical disability, mental disability, ancestry, place of origin, marital status, source of income, family status, or sexual orientation.
- If the member fails to comply with this policy then the member will be required to attend a Board of Directors meeting with termination of residency and membership as a possible outcome.
